Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the App (the “Service”), operated by the App(“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

4. Intellectual property

Our content

The Service and its original content (excluding user-submitted content), design, and underlying software are the exclusive property of the App and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

Your content

You retain full ownership of any content you submit, upload, or create through the Service (“User Content”). By submitting User Content, you grant us a limited, worldwide, royalty-free, non-exclusive licence to host, store, transmit, and display that content solely as necessary to provide the Service to you. We do not use your User Content to train AI models or for any purpose beyond operating the Service.

You represent that you have all rights necessary to grant this licence and that your User Content does not infringe any third party’s rights.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

6. Third-party services

The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of those services. Your use of third-party services is at your own risk.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN the United States, IN NO EVENT SHALL the App BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

9. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.

If you are a consumer located in the European Union, you may also benefit from any mandatory provisions of the law of the country where you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory local law provisions.

10. Termination

You may close your account at any time by contacting us at support@example.com. We may terminate or suspend your access at any time, with or without cause, with or without notice. Upon termination, your right to use the Service immediately ceases.

Sections 4 (Intellectual property), 7 (Disclaimer of warranties), 8 (Limitation of liability), 9 (Governing law), and 12 (General) survive termination.

11. Changes to these Terms

We may revise these Terms at any time. Material changes will be communicated via email or a prominent notice in the Service at least 14 days before they take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you disagree, you must stop using the Service before the new Terms take effect.

12. General

These Terms constitute the entire agreement between you and the App regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
